Our firm does not charge anything to the consumer. All of our fees and costs are paid directly by the respective manufacturer or dealer.

The bottom line is that we do not charge our clients.

A “Lemon” is any vehicle or RV with defects that were covered by a warranty.  The manufacturer or dealer has to be provided with a reasonable number of repair attempts.  Case law says that a manufacturer must be provided with a minimum of two (2) repair attempts, but the general rule is four (4) repair attempts.   

Even if your car, truck, SUV or RV is out of warranty, we may still be able to help you.  The question is this.  Do the current defects relate back to repairs that occurred during the warranty period.  We can help you sort out what claim you may have outside of the warranty period.

Unfortunately, no we do not do that.  However, generally speaking if you remember this simple rule when you are at the dealership, you should be okay:  The dealer needs you more than you need the dealer. 

You always have the option to demand that a manufacturer or dealer to repurchase your vehicle or RV.  However, hiring an attorney will frequently speed up the process and provide greater credibility to your claim.  An attorney will also make sure the manufacturer or dealer doesn’t cheat you out of all money available to you.

The answer to this question depends on the following:

1.  Did you buy the vehicle as Certified Pre-Owned?

2.  Did the selling dealership provide a warranty?

3.  Did the selling dealership misrepresent the history or condition of the vehicle?

Unfortunately, we cannot force a manufacturer or dealer to make an offer before they are ready.  All we can do is apply pressure to try and get them to make a decision.  Some manufacturers act more efficiently than others. So it all depends, but a quick case will typically take 3-4 months with a trial being set 18 to 24 months.  

The determining factor is where did title transfer.  The quick analysis is where did you get the keys to the vehicle or RV. 

If you received the keys in California, then California consumer protection statutes apply.  But there are exceptions.  One exception is if you are active-duty military stationed in California.  Then California’s lemon law applies to you.

The simple answer is Dealer Fraud or unfair business practices is when the dealer lies or misrepresents the history or condition of the vehicle before you buy the vehicle or RV. 

Lemon Law is when the manufacturer or seller cannot fix or repair the vehicle or RV.

More often than not, the answer to this question is “Yes.”  But this doesn’t mean you do not need an attorney.  In fact, manufacturers and dealers will more often than not respond more favorably to your demand after you then hire an attorney.  So make the demand, and then have an attorney get it finalized for you.
